India Legal Issues Surrogacy

Surrogacy - Not sure what to make of this case at this point, but it appears that there are many issues involved here, including bias against a homosexual parent, children created through surrogacy in India, and possible child neglect. I really hope this has a happy ending.

Surrogacy - the case of the German twins (and now an Israeli man and a French man) born via an Indian surrogate who were just recently allowed to go home to Germany after a two year battle illustrates the urgent need for legislation to regulate the growing surrogacy industry in India.

In a case involving twins born of a surrogate mother in India, it looks as if all will work out after a two month wait:

"Dan Goldberg and his children will arrive in Israel from India during the weekend, according to family members.

According to reports in the Times of India, the new surrogacy bill in India is set to protect the child's interests:

"NEW DELHI: Having emerged as the hottest destination for surrogacy, it is but natural for India to take the lead in evolving a law that safeguards the interests of all the parties concerned, including the child born through assisted reproductive technology (ART).

Good news on the homefront for the twins born in India to a single father from Israel. We have commented on this case several times for the last few weeks, and it looks as if the Prime Minister now is involved.

Prime Minister Benjamin Netanyahu said on Monday a gay father waiting in India with his infant twin sons due to the Interior Ministry's refusal to administer a paternity test must be allowed to come back to Israel.

The case in India over the German couples' twins continues:

"Jan Balaz, father of two twin babies born through surrogacy in Anand, has filed a contempt petition against the passport authorities for non-compliance with the order of the Gujarat High Court.

Balaz recently won a legal case against the Regional Passport Authority in getting the Indian passports of his children returned.
