Surrogate Mothers – What is the current status?

Surrogacy, or surrogate motherhood, allows two persons to have a child with their genetic characteristics. Indeed, male and female gametes are inseminated in the surrogate mother and the embryo will grow in her belly. The real parents will get the baby at birth.

Surrogacy is already accepted in some countries and could be the solution for people who cannot have children – gay couples or straight couples with problems bringing pregnancy into fruition.

This solution seems to suit a lot of co-parents that chose surrogacy. Every year, 300 to 400 couples go abroad or risk criminal sentences concealing the help of a friend to have a child. Indeed, surrogacy is still illegal in France.

Legislation against surrogate mothers

When the list of countries authorizing the recourse to a surrogate mother gets longer (Canada, Australia, England, South Africa, etc.), law strictly prohibits surrogacy in France. The goal is to avoid surrogacy to be subject to money transactions, but in reality, there is no tolerance, even when the surrogate mother does not ask for anything in return. Most people might be in favor of surrogacy, but law keeps prohibiting it.

In the current state of legislation, children born abroad thanks to a surrogate mother will not be registered under his parents’ name on the register of births.
